1. Acceptance of Terms

This End User License Agreement ("Agreement" or "EULA") is a binding agreement between you ("User" or "you") and 6 Piston Diesel Repair ("we", "us", "Provider") governing your use of the 6 Piston Shop Board software application (the "Application"). By installing, accessing, or using the Application, you agree to be bound by this Agreement. If you do not agree, do not install or use the Application.

2. Description of the Application

The 6 Piston Shop Board is an internal business management application used by 6 Piston Diesel Repair to track service work, manage shop operations, and integrate with third-party business services including Intuit QuickBooks Online. The Application is intended solely for use by authorized employees and representatives of 6 Piston Diesel Repair.

3. License Grant

Provider grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Application solely for the internal business operations of 6 Piston Diesel Repair, subject to the terms of this Agreement and any applicable third-party API terms, including but not limited to Intuit Developer Terms of Service.

4. Authorized Use

You must be an authorized representative of 6 Piston Diesel Repair to use this Application. You agree to:

Use the Application only for legitimate internal business purposes
Keep your login credentials (PIN) confidential and not share them with unauthorized persons
Not attempt to gain unauthorized access to any portion of the Application or its underlying systems
Comply with all applicable laws and third-party service terms

5. Restrictions

You shall not, and shall not permit any third party to:

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Application
Modify, adapt, translate, or create derivative works based on the Application
Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Application
Use the Application to violate any applicable law, regulation, or third-party terms of service
Use the Application to access data outside of 6 Piston Diesel Repair's authorized business accounts

6. Third-Party Services

The Application integrates with Intuit QuickBooks Online via the Intuit Developer API. Your use of QuickBooks Online data through this Application is subject to Intuit's terms of service and privacy policy. Provider is not responsible for the availability, accuracy, or reliability of any third-party service.

7. Data and Privacy

Information collected, accessed, or stored by the Application is handled in accordance with our Privacy Policy, which is incorporated into this Agreement by reference. Data accessed via the QuickBooks Online API is used solely for internal business reporting and remains the property of 6 Piston Diesel Repair.

8. Intellectual Property

The Application, including all source code, designs, documentation, and related materials, is the property of 6 Piston Diesel Repair and is protected by applicable intellectual property laws. No rights or licenses are granted except as expressly stated in this Agreement.

9. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. PROVIDER DOES NOT WARRANT THAT THE APPLICATION WILL BE ERROR-FREE OR THAT ACCESS WILL BE CONTINUOUS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PROVIDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION, REGARDLESS OF THE CAUSE OF ACTION.

11. Termination

This Agreement is effective until terminated. Provider may terminate or suspend your access to the Application at any time, with or without notice, for any reason. Upon termination, your right to use the Application immediately ceases. Sections 5, 7, 8, 9, 10, and 12 survive termination.

12. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any dispute arising under or in connection with this Agreement shall be resolved in the state or federal courts located in Florida.

13. Changes to This Agreement

Provider may update this Agreement from time to time. The "Last Updated" date at the top of this page indicates when the most recent revisions were made. Continued use of the Application after such changes constitutes acceptance of the revised Agreement.
